Governor Andrew Cuomo

You are always talking about corruption in the legislative branch, yet, you do not discuss the deprivation and illegal imprisonments in NY. Every day that the family court is in session a father or mother is sentenced to jail or denied access to their child in an illegal closed court proceeding. This is more fully documented in my video:

Family Court proceedings are illegally closed (10:36)

The closing of the court is in violation of state statute: Family Court Uniform Rules Section 205.4 Access to Family Court Proceedings.

The closing of the court when a parent is charged with contempt for not paying child support or the loss of time with a child is also in violation of US Supreme Court rulings:

Argersinger v. Hamlin, 92 S.Ct. 2006 (1972) at 2008 held: It is “the law of the land” that no man’s life, liberty or property be forfeited as a punishment until there has been a charge fairly made and fairly tried in a public tribunal.

Matter of Chase, Family Court, 446 N.Y.S.2d 1000 (1982), 112 Misc.2d 436

The Supreme Court instructs that all trials, civil and criminal, are presumptively open, in vindication of an independent right of access of the public and the press.

This mutual interest in an independent relationship has received consistent support in the cases of the Supreme Court. “The Court has frequently emphasized the importance of family. The rights to conceive and raise one’s children have been deemed essential”. Mayer v. Nebraska, 262 U.S. 390, 399. (1923), “basic civil rights of man”, Skinner v. Oklahoma, 316 U.S. 535, 541 (1942) and “rights far more precious than property rights, May v. Anderson, 345 U.S. 528, 533 (1953).

Having one’s child taken from them is a more severe penalty then being sent to jail for six months or year. The right to one’s child is a “right far more precious than property rights” then why are litigants entitled to public trials on issues concerning property rights or if they are accused of a crime but are not entitled to a public trial concerning the right to see their children and have a relationship with them? This makes no sense! DO NOT tell me the court is closed to protect the children. The children are abused by the system! The court is closed to cover-up the illegal actions of the judges and attorneys!

As documented on my website, www.justice4ny.com, every man, women and child (including our veterans and their family members) currently in jail, in the case of children in detention, by a Family Court Judge is illegally in jail. Notice, there is NO exception to my statement!! It is upon Information and belief that every one of them have been denied their State and Federal Constitutional Rights to Due Process and Equal Protection of the Law. Further, they have been denied at least one of the following and in most cases, they have been deprived of several of their Constitutional rights, such as, a Public Trial; a Jury Trial, a Court of Proper Jurisdiction, their rights to have a Judge hear their matter, and/or Competent Assistance of Counsel. The aforementioned being covered up by State and Federal Judges with the help of the Drive-by Liberal News Media in New York.

Governor, do you believe these judges and support magistrates should be removed from office and be arrested for official misconduct in the closing of the family court proceeding in violation of the law? There are requirements to close the court in each instance. You keep stating that no one is above the law. Well, are the judges and attorneys above the law? What are you going to do about these illegal imprisonments?

Do you believe that anyone deprived of their constitutional right to a public trail should be immediately released from jail?

Why don’t you order Eric Sneiderman go after these corrupt judges, support magistrates and attorneys for participating in illegal court proceedings?

You and Sneiderman fight for the “so-called” rights of immigrants to come to this country, why don’t you fight for the rights of the citizens of New York?

The NYS attorney general does not have an email address. Why?
